This page explains how the PartStall car spare parts warranty works, when it applies and when it does not.

1. General provisions – who and what the warranty applies to

1.1. These warranty terms (hereinafter the Terms) apply to new car spare parts (used spare parts: clause 1.6) sold via PartStall OÜ (hereinafter the Seller), unless otherwise provided in the manufacturer’s or importer’s warranty conditions.

1.2. The Seller is not the manufacturer of the spare parts sold. All warranty claims are handled on the basis of the manufacturer’s or importer’s warranty rules. If the manufacturer’s conditions are stricter or more specific than these Terms, the manufacturer’s conditions shall apply.

1.3. The Terms have been drawn up in accordance with the Law of Obligations Act of the Republic of Estonia and consumer protection principles. In addition to the warranty, the consumer always has rights arising from the law, which cannot be derogated from to the detriment of the consumer.

1.4. The Terms apply both to spare parts delivered within Estonia and to spare parts delivered to other countries, provided that the manufacturer’s warranty foresees international or regional validity.

1.5. These warranty terms do not limit or exclude the consumer’s statutory right to submit claims regarding non-conformity of goods with the contract for up to 2 years from the date of delivery of the goods.

1.6. Used spare parts (sold as separate items with photos of the actual part and a condition grade A, B, C or "For parts"): the Seller guarantees that the part fits the vehicle(s) stated in the product description and that it works at the time of delivery. The condition, wear and any faults stated in the product description and shown in the photos are part of the contract and are not a defect. Parts graded "For parts" are sold for spare parts or repair only and are not guaranteed to work. The consumer's statutory rights (clause 1.5) also apply to used parts.

2. Warranty period – how long the warranty is valid

2.1. The warranty period is manufacturer-specific and depends on the particular spare part and its manufacturer. As a rule, the warranty period ranges from 6 months to 2 years, unless the manufacturer has set a different term.

2.2. The warranty period starts from the date on which the spare part is handed over to the buyer (invoice or delivery note date). If the goods are delivered by courier or parcel machine, the warranty period starts from the initial date of delivery.

2.3. Unless otherwise provided in the manufacturer’s warranty conditions, the warranty period does not stop or extend due to the handling of the warranty case or the time required for expert assessment of the spare part.

2.4. If a defective spare part is replaced with a new one, the replacement part is covered by the same original warranty period and not a new term, unless the manufacturer has explicitly granted a new warranty period.

3. Wear parts and consumables – limited warranty

3.1. The warranty for spare parts is limited in the case of products that are by their nature wear parts or consumables. For such products, each potential warranty case is assessed individually, taking into account the manufacturer’s instructions and natural wear.

3.2. The following products may have limited warranty or special handling (illustrative list, not exhaustive):

  • brake pads, discs, drums and linings;
  • clutch discs and other clutch system components;
  • oils, greases, coolant and brake fluids, other operating fluids;
  • filters (air, fuel, cabin, oil filters, etc.);
  • bulbs, fuses, various electrical accessories;
  • wiper blades;
  • exhaust system components;
  • spark plugs and glow plugs;
  • wheel bearings and other lifting and steering/suspension components;
  • antenna rods, batteries and accumulators (except where the manufacturer provides an extended warranty).

3.3. For wear parts, the assessment of a warranty case takes into account typical usage, mileage and maintenance regime. Natural wear arising from normal use of the product in accordance with the manufacturer’s instructions is not considered a defect.

4. When the warranty does not apply – typical exclusions

The warranty does not apply and the Seller may reject a warranty claim if one or more of the following circumstances are present:

4.1. The buyer does not submit a claim within a reasonable time after the defect appears and, in the case of a consumer, no later than 2 months from discovering the defect. For business customers, shorter deadlines may apply under the manufacturer’s conditions or agreement with the Seller.

4.2. The defect in the spare part has arisen from incorrect or improper installation, use or maintenance, including:

  • installation contrary to the manufacturer’s instructions;
  • incorrect tightening torque or fastening method;
  • ignoring prescribed maintenance intervals.

4.3. The spare part has been modified, rebuilt or “tuned” in a way not foreseen or approved by the manufacturer.

4.4. Damage has arisen:

  • as a result of an accident or other incident;
  • from racing or other extreme use;
  • due to overloading the vehicle, improper load distribution or unsuitable additional accessories;
  • due to the use of incorrect operating fluids, oil, coolant or similar;
  • due to faulty electrical connections or overvoltage phenomena.

4.5. Damage has been caused by forces of nature (fire, flood, lightning, storm, etc.) or other circumstances beyond the control of the Seller.

4.6. After handover by the Seller, the spare part has been stored or transported incorrectly (moisture, corrosion, impact damage, dropping, etc.).

4.7. The spare part has been installed without sufficient professional skills or proper tools, including where installation has not been carried out in a workshop or by a competent specialist, if so required by the manufacturer.

4.8. The defect is related to the natural wear of the spare part (e.g. brake pads, filters, seals, fluids and similar).

4.9. The manufacturer or importer has determined during expert assessment that the spare part complies with technical requirements and that the defect is not a manufacturing or material fault.

5. Submitting a claim and expert assessment – how to proceed

5.1. The buyer must inform the Seller of any defect found in the spare part without undue delay, but no later than 2 months from discovering the defect. Late notification may significantly complicate the warranty process or provide grounds for rejecting the claim.

5.2. The claim must be submitted in written form to the Seller’s e-mail address info@partstall.ee or by post to the Seller’s address. The claim must include:

  • the buyer’s name and contact details;
  • invoice or order number;
  • product name and code (manufacturer’s code, if possible);
  • precise description of the defect;
  • time and conditions under which the defect appeared;
  • where possible, photos or other visual evidence.

5.3. A valid proof of purchase (invoice, order confirmation or receipt) is required as the basis for a claim. If this is missing, the Seller may have grounds to reject the warranty claim.

5.4. Assessment of the warranty case is based on an expert opinion provided by the manufacturer or importer, or on a technical report prepared by a partner authorised by the Seller. If necessary, the spare part may need to be removed and returned to the party performing the expertise.

5.5. If the expert assessment shows that there is no warranty defect (e.g. incorrect installation, normal wear, external damage), the buyer shall bear the costs of diagnostics, expertise, disassembly and return in accordance with the service provider’s valid price list.

5.6. The Seller will respond to the submitted claim within 15 days from receipt. In more complex cases, where an opinion from the manufacturer or foreign partner is required, the buyer will be informed of a longer handling period.

6. Resolving a warranty case

6.1. If the warranty case is confirmed, the Seller (in line with the manufacturer’s warranty) has the right to choose between the following solutions:

  • repairing the defective spare part free of charge, if this is technically and economically reasonable;
  • replacing the spare part with a new equivalent part;
  • financial compensation, generally based on the current selling price of the spare part or an agreed proportion (taking into account usage period and wear).

6.2. The extent, method and exact procedure of compensation are determined on the basis of the manufacturer’s or importer’s warranty conditions and the specific circumstances. The buyer does not have the right to demand one specific solution if the manufacturer’s conditions provide for a different method.

6.3. The Seller and the manufacturer do not compensate, in the context of a warranty case:

  • costs of installation and removal of the spare part, unless explicitly provided otherwise in the manufacturer’s conditions;
  • transport, towing, replacement vehicle or other indirect costs;
  • workshop labour time that has not been agreed in advance in writing with the Seller or the manufacturer – compensation for labour time is only possible in exceptional cases.

6.4. All spare parts replaced under warranty become the property of the Seller or the manufacturer, unless otherwise agreed in writing.

7. Force majeure

7.1. The Seller is not liable for failure to perform or delay in fulfilling warranty obligations if the reason is force majeure, i.e. a circumstance that the Seller could not influence or reasonably foresee.

7.2. Force majeure cases include, among others, but are not limited to:

  • natural disasters;
  • war, unrest, strikes;
  • state restrictions and sanctions;
  • serious supply disruptions;
  • extensive IT or energy system failures.

7.3. In the event of force majeure, the Seller will take all reasonable measures to mitigate the consequences and will inform the buyer as soon as possible.

8. Relation to sales terms and law

8.1. These warranty terms form part of the PartStall OÜ sales terms and must be read together with the sales terms and the privacy policy.

8.2. If there is a conflict between these Terms and the manufacturer’s warranty conditions, the manufacturer’s warranty conditions shall apply, provided that they are not less favourable to the consumer than the statutory minimum.

8.3. If any provision of these Terms conflicts with mandatory legal norms of the Republic of Estonia, the relevant legal provision shall apply and the conflicting Term shall be valid only to the extent that it is not contrary to the law.
